The State of Alaska has filed a motion to dismiss an American Civil Liberties Union lawsuit. The ACLU filed the suit in response to Governor Dunleavy's $334,700 line item veto to the Alaska Court System.
Dunleavy vetoed the money after the Alaska Supreme Court ruled that the state had to fund abortions with medicaid money. The reduction reflects the amount of money the state spends on abortions each year.
The ACLU sued saying the move was unconstitutional.
Attorney General Kevin Clarkson said in a statement today, "As a result of the ACLU's complaint we are now having to spend finite legal resources defending what is clearly within the governor's express constitutional veto authority."
